These Terms of Use (“Terms”, “Agreement”) govern your access to and use of FitAD.ai, its applications, and related services (the “Platform”). By using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use FitAD.
2. About FitAD
FitAD (“we”, “us”) is an AI-powered influencer and performance marketing platform that connects brands, creators, and campaigns. The Platform enables campaign management, influencer discovery, content workflows, analytics, and AI-driven recommendations.
3. Eligibility
- You must be at least 18 years old
- You must provide accurate account information
- You must comply with applicable laws
- You must not be restricted from using similar platforms
4. Accounts & Security
You are responsible for maintaining the security of your account. FitAD is not liable for unauthorized access caused by failure to protect login credentials.
5. Creator Responsibilities
- Deliver original and high-quality content
- Follow campaign briefs and deadlines
- Comply with disclosure laws (FTC / local regulations)
- Do not use fake followers or engagement
- Provide accurate account data when required
6. Brand Responsibilities
- Provide clear campaign briefs
- Supply required products or assets
- Review and approve deliverables on time
- Ensure timely payment for services
7. Payments & Fees
FitAD may charge platform fees or service fees. Creator payouts are released after campaign approval and may be held in cases of fraud, disputes, or compliance review.
8. Campaign & Deliverables
All deliverables must comply with campaign requirements, legal standards, and platform policies. FitAD may remove content that violates rules or regulations.
9. Intellectual Property
Creators retain ownership of their content unless otherwise agreed. By participating in campaigns, creators grant brands a license to use approved content for agreed marketing purposes.
10. Prohibited Activities
- Fraud or misrepresentation
- Fake engagement or traffic manipulation
- Bypassing platform payments
- Illegal or harmful content
- Abuse of messaging or review systems
11. AI Features
FitAD uses AI to recommend creators, optimize campaigns, and suggest content strategies. AI outputs are not guaranteed and should not be treated as final decisions.
12. Data & Privacy
Use of the Platform is subject to our Privacy Policy. We collect data to operate campaigns, improve performance, and enhance user experience. We do not sell personal data.
13. Third-Party Services
FitAD integrates with third-party platforms such as TikTok, Instagram, YouTube, and payment providers. Their terms also apply when using those services.
14. Termination
We may suspend or terminate accounts for violations, fraud, or misuse of the Platform. Some access or payments may be restricted after termination.
15. Disputes
Users should attempt to resolve disputes directly. FitAD may assist but is not responsible for resolving all conflicts between users.
16. Liability
FitAD is provided “as is.” We are not responsible for indirect damages, data loss, or losses caused by third-party services.
17. Indemnification
You agree to hold FitAD harmless from claims resulting from your use of the Platform, content, or interactions with other users.
18. Changes to Terms
We may update these Terms at any time. Continued use of the Platform means you accept the updated Terms.
19. Governing Law
These Terms are governed by the laws of the State of Delaware, United States.
